Non-compete litigation

For those of you that negotiate non-compete clauses in either employment contracts or business purchase/sale agreements, check out this ongoing litigation in Berwick, NS.  A former pharmacist-employee is planning to open a competing drugstore in the same town, even though he allegedly signed a non-compete over 15 years ago.  Note Justice Edwards’ “concerns” over the non-compete period of five years, which is a very common period for such things, in my experience.
